McLean Victims May Owe Millions, Trustee Claims

Boult Cummings attorney, Bill Norton, is representing Fred Goad, a prominent investor in Nashville, in a matter related to a massive Ponzi Scheme set up by the late Robert McLean. A trustee administering McClean's bankruptcy, Bob Waldschmidt, has filed suit to reclaim $11.4 million in interest payments that Waldschmidt claims were improperly paid to McClean's investors. As for his client, Norton responded that he would be "asserting the defense under the avoidance statute that the Defendants have setoff claims for investments made in good faith...Since in all of these cases, the amounts invested exceeded any amounts paid by McLean, there should be no liability."
