By working closely with our clients, we develop proactive solutions to complex environmental matters. Our Environmental attorneys have been on the leading edge of a large number of environmental issues and are active participants in state and national professional and trade associations that impact the formation of environmental laws.

We handle matters for a diverse group of clients, including both large and small business, major industrial and manufacturing companies, environmental consulting firms, remediation contractors, real estate companies and developers, financial institutions, individual property owners and health care organizations.

Our work has included representing clients before administrative boards and in litigation in federal and state courts, performing environmental due diligence reviews as part of the purchase of real estate or businesses, and providing counsel to businesses as they pursue mergers and acquisitions.

• Advise buyers, sellers, developers and financiers of real estate in property transactions that involve environmental issues.
• Advise parties concerning environmental consulting, engineering and remediation contracts.
• Advise on Tennessee environmental laws, rules and regulations related to stormwater underground storage tanks, wetlands, air pollution, solid and hazardous waste, Superfund, landfill permits and related zoning issues.
• Environmental due diligence reviews on behalf of lending clients and clients purchasing property or businesses.
• Provide counsel to large and small businesses in relation to environmental issues arising in merger and acquisition agreements.
• Provide counsel to parties involved in real estate transactions in which environmental issues are apparent. Common environmental matters have included underground storage tanks, asbestos, and general environmental warranties and representations.
• Represent real estate holding companies in connection with landfill closure, permitting of hazardous waste landfill, surface mining permits and wetlands issues, as well as routine Phase I audits and remediation issues.
• Provide counsel on environmental issues to commercial lenders that are lending money for real estate property purchases and business mergers and acquisitions, including review of the ASTM standards for Phase I audits and development of lending policies and procedures.
• Review environmental assessment reports and compliance audit reports for clients in both real estate transactions and acquisitions to assess liability of seller and/or buyer.
