Creditors' Rights and Insolvency


Boult Cummings Creditors' Rights and Insolvency attorneys are experienced in all aspects of insolvency problems, ranging from out-of-court workouts of troubled loans to protecting a client's interest in bankruptcy cases. Our attorneys have represented both borrowers and financial institutions in complex lending transactions and have the expertise to structure and document all types of workout agreements, including intercreditor agreements, loan modifications, forbearance agreements, subordination agreements and liquidation agreements.

On the creditor's side, we frequently assist lenders with foreclosures, receiverships, creditor assignments, repossessions and other remedies. Additionally, our attorneys have experience dealing with all types of assets, including real estate, accounts, inventory, equipment, trademarks, patents and copyrights. 

We also have broad experience in bankruptcy cases, representing Chapter 11 debtors, creditors' committees, bondholder committees, employee committees, equity committees, bankruptcy trustees, bondholders, indenture trustees, landlords/tenants, trade creditors, secured creditors and equity holders.
