Boult Cummings attorney, Jay Hardcastle, was quoted in the Nashville Business Journal  article entitled "Constancy of Change Means Job Security for Health Care Lawyers." The article discusses the ever-changing nature of the health care industry, which is largely driven by regulations from state and federal governments.  "Whether law changes are more restrictive or less, health care professionals have to understand in detail what is and isn't allowed," says Hardcastle.  He further states that three main regulatory areas are influencing the current increase in business.  They include:
  • A continuing trend of hospitals employing more specialists, a highly regulated area.
  • New restrictions on physician-owned ancillary services, such as MRIs, lab services and others.
  • A possible relaxing or restricting of gainsharing between hospitals and physicians. Gainsharing is an arrangement where physicians work with hospitals to share the profits associated with reducing wasteful spending.
